Terms & Conditions
Effective date: 2 August 2026
These Terms & Conditions ("Terms") govern your use of the Deski desktop application and this website (together, the "Service"). By downloading, installing, or using Deski, you agree to these Terms. If you do not agree, please do not use the Service.
Important — please read
Deski is provided "as is", with no warranties, and its recorded times may be incomplete or inaccurate — do not rely on them as your sole record for billing, payroll or legal purposes without checking them. To the maximum extent permitted by law, we are not liable for any loss or damage, direct or indirect, arising from your use of Deski, and our total liability is limited as set out below. Your locally stored data is your responsibility to back up. See Disclaimer of warranties, Limitation of liability and Your data and responsibility.
1. The Service
Deski is a local-first desktop time-tracker for tracking your own computer activity on devices you own or control. It runs on your own device and stores your activity data locally — nothing you track is uploaded. Deski is offered as a paid subscription with a 14-day free trial (see Section 2).
If you are using a pre-release or beta build, additional terms apply — see Section 16.
2. Subscription, trial and billing
Deski is a monthly subscription, currently $5 per month (plus any applicable taxes), at the price displayed at checkout. Every new user gets a 14-day free trial of the full app. A payment method is collected at sign-up, but you are charged $0 during the trial. If you cancel before the trial ends, you owe nothing; otherwise the subscription begins when the trial ends. The free trial is limited to one per account: if your trial ends or is cancelled and you later resubscribe, the paid subscription starts immediately, without a new trial period.
Payments are processed by Freemius (Merchant of Record)
Our order process is conducted by our online reseller Freemius, Inc. Freemius is the Merchant of Record for all orders: your purchase contract is with Freemius, which handles payment processing, applicable sales taxes (such as VAT), invoicing, and billing-related customer service. Your purchase is also subject to Freemius's Terms of Use and Freemius's Privacy Policy. We never see or store your card details.
Automatic renewal
After the free trial, your subscription renews automatically each month unless cancelled, and the then-current fee is charged to your saved payment method. If we change the price, we will give you notice in advance and the new price will only apply from a subsequent renewal.
Cancellation
You may cancel at any time, and cancelling is as easy as signing up:
- in the app, via Settings → Account → Cancel subscription; or
- via the manage-subscription link in any Freemius receipt email (the Freemius Customer Portal); or
- by emailing [email protected].
Cancellation stops future renewals. Your access continues until the end of the period you have already paid for (or, during a trial, until the trial ends), and you will not be charged again.
3. Refunds
We offer a 14-day money-back guarantee: if you are unhappy with Deski for any reason, request a refund within 14 days of a purchase or renewal and we will refund that charge in full. To request one, email [email protected] from your account email, or use the contact option in your Freemius receipt email. Refunds are processed through Freemius, our Merchant of Record, back to your original payment method. Nothing in these Terms limits any statutory refund or withdrawal rights that cannot be waived in your country.
4. Accounts, eligibility and sign-in
You must be old enough to form a binding contract in your country (at least 18, or the age of majority where you live) to purchase a subscription. Using your subscription requires signing in with your email address. There are no passwords — we email you a one-time code to confirm it's you. You are responsible for maintaining access to, and the security of, your email account. Sign-in sessions expire after 90 days of inactivity. See our Privacy Policy for what we store (in short: your email, and nothing you track).
5. License to use
Subject to these Terms, you are granted a personal, non-exclusive, non-transferable, revocable license to install and use Deski on devices you own or control. This license does not transfer any ownership of the software to you.
6. Acceptable use
You agree not to:
- use Deski to track or monitor any person other than yourself — Deski is a personal self-tracking tool, and installing it on another person's device, or using it to surveil another user of a shared device, is prohibited;
- reverse engineer, decompile, or disassemble the software except to the extent permitted by applicable law;
- remove or alter any proprietary notices contained in the software;
- use the Service to violate any applicable law or the rights of others;
- redistribute, sell, or sublicense the software except as expressly permitted by its license terms.
7. Your data and responsibility
Because Deski stores your data locally on your device, you are solely responsible for that data, including creating backups and keeping your device secure. We have no access to your data and cannot recover it if it is lost, deleted, or corrupted. See our Privacy Policy for how the app handles data.
8. Intellectual property
The Deski name, logo, software, and website content are owned by Deski and/or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use them except as expressly set out here.
9. Third-party platforms and links
Deski may be distributed through, or rely on, third-party operating systems, app stores, or hosting providers. Your use of those platforms is subject to their own terms, and we are not responsible for them. Our website and app may link to third-party websites or services we do not control, and we assume no responsibility for their content or practices.
10. Termination
You may stop using Deski at any time — cancel your subscription (Section 2) and, if you wish, delete your data from within the app. We may suspend or terminate your access to the Service if you materially breach these Terms (for example, the acceptable-use rules in Section 6), where required by law, or if the Service is discontinued. Where the breach is curable, we will make reasonable efforts to notify you and give you a chance to remedy it first. If we terminate without cause during a period you have paid for, we will refund you on a pro-rata basis (processed through Freemius). Sections that by their nature should survive termination (including Sections 8, 11 and 12) do survive.
11. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data it records will be accurate or complete.
No reliance on recorded time. Deski measures activity automatically and its records may be incomplete or inaccurate — for example where the app is closed, the device sleeps, tracking is disabled, a session is edited, or activity is misattributed. You must independently verify any figures before relying on them, and you agree not to rely on Deski as your sole record for invoicing or billing clients, payroll, employment decisions, or legal, tax, regulatory or contractual purposes. Deski is a personal productivity tool, not a system of record, and we accept no responsibility for decisions made or amounts charged on the basis of its output.
12. Limitation of liability
To the maximum extent permitted by law, Deski and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid for the Service in the 12 months preceding the event giving rise to the claim (or, if you have paid nothing, USD 50). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
13. Changes to the Service and Terms
We may modify, suspend, or discontinue the Service, and we may update these Terms, at any time. When we update these Terms, we will revise the "Effective date" above, and for material changes we will make reasonable efforts to give you advance notice (for example by email or an in-app notice) before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing law and disputes
These Terms are governed by the laws of the United Republic of Tanzania, without regard to its conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in Dar es Salaam, Tanzania.
Talk to us first: if you have a concern or dispute, please contact [email protected] and give us a chance to resolve it informally before taking formal action.
EU/EEA consumers: if you are a consumer in the European Union, you benefit from any mandatory provisions of the law of the country in which you are resident — nothing in these Terms affects your rights under those provisions.
15. Severability, waiver and entire agreement
If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary (or severed) and the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver of it. These Terms, together with the documents they reference (the Privacy Policy and Freemius's Terms of Use for purchases), are the entire agreement between you and us regarding the Service.
16. Beta and pre-release software
From time to time we make beta or pre-release builds of Deski available to testers. This Section applies to those builds and overrides anything to the contrary elsewhere in these Terms.
- Provided as-is, and expect defects. Beta builds are unfinished and untested software. They may crash, behave incorrectly, record inaccurate times, or lose or corrupt data you have already recorded, including across updates. Do not rely on a beta build as your only record of anything that matters — export or back up your data (Settings → Data) before updating. The disclaimers in Section 11 and the liability cap in Section 12 apply in full.
- Access is temporary and revocable. Beta access runs for a limited period (currently 30 days) and we may suspend, withdraw, or end it, or discontinue the beta programme entirely, at any time and without notice or compensation. A beta build may stop working when that period ends.
- No support commitment. We are glad to hear from testers, but we do not promise any response time, bug fix, uptime, or that any reported issue will be addressed at all.
- Not for production or billing use. Beta builds must not be used as the source of record for client invoicing, payroll, legal timekeeping, or any other purpose where inaccurate data would cause loss.
- Feedback. If you send us feedback, bug reports, or suggestions, you grant us a perpetual, worldwide, royalty-free licence to use them to improve Deski, without obligation or compensation to you. Please do not send us anything you consider confidential or that you are not free to share.
-
Unsigned installers. Beta builds are not yet
code-signed, so Windows may warn you that the publisher is unknown. Only
install a build you downloaded from a link we sent you, and check it
against the published
SHA256SUMS.txtif you want to verify it. - Test purchases. Where we ask you to exercise the checkout flow, it runs in a sandbox with test card details. No real payment is taken and no subscription is created.
Everything in our Privacy Policy applies to beta builds unchanged: your tracking data stays on your own device.
